Terms of use of the NativeRadar service.
1. The service
NativeRadar records promotional articles published on news portals in Bosnia and Herzegovina and provides reports, dashboards and alerts about them to publishers, media agencies and advertisers ("Clients"). Access is granted to a Client under a written agreement or order, and to named users within the Client by personal access links.
2. Access
- Each user receives a personal access link. The link is confidential, belongs to that person and must not be shared or forwarded.
- The Client is responsible for the people it asks us to give access to, and must tell us when a person leaves or no longer needs access.
- We may suspend or revoke a link at any time for security reasons, for breach of these terms, or at the end of the Client's agreement.
3. What you may do with the data
The Client may use NativeRadar data and reports for its own internal business purposes: planning, analysis, sales and reporting to its own clients and management. The Client may not resell the data, publish it as a dataset, feed it into another commercial product, or use it to build a competing service. Figures may be quoted in the Client's own presentations and materials with the source named as NativeRadar.
4. Confidentiality of each party's share
A publisher sees its own figures and the market in aggregate. Figures that identify another portal by name are shown only in reports whose recipients are entitled to them under their agreement. The Client agrees not to pass on figures about a named third party to that third party or to the market.
5. What the numbers are
- NativeRadar counts promotional articles only, as published on the portals we read. Editorial content is not counted.
- Value is an estimate: the number of articles multiplied by the portal's published list price. It is not an invoice, not revenue and not a measure of what anyone actually paid.
- Coverage is the set of portals we read, which changes over time. We state the covered portals and period with every report.
- Automated reading and classification can contain errors. We correct them when found. The data is provided as is, for information, and the Client stays responsible for decisions made on it.
6. Intellectual property
The service, its software, methodology, classification rules and the compiled database are the Provider's property. The articles themselves remain the property of their publishers. NativeRadar stores them as a record and links to the original pages.
7. Availability
We aim to keep the service available at all times, but do not guarantee uninterrupted service. Planned maintenance is announced inside the dashboard where practical.
8. Liability
The Provider is not liable for indirect or consequential loss, loss of profit or loss of data arising from use of the service. The Provider's total liability in any twelve month period is limited to the fees the Client paid for that period. Nothing here limits liability that cannot be limited by law.
9. Term and ending
These terms apply for as long as the Client's agreement runs. Either party may end the agreement with 30 days' written notice unless the agreement says otherwise. The Provider may end access immediately for a material breach. When access ends, the Client's users lose their links and the Client's account data is deleted within 90 days.
10. Law and disputes
These terms are governed by the law of Bosnia and Herzegovina. Disputes go to the competent court in Sarajevo, after a good faith attempt to settle them directly.
11. Changes
We may update these terms with 30 days' notice inside the dashboard or by email. Continued use after that date means acceptance.
